MANA SATU POLIS, MANA SATU PENJENAYAH? TUN HANIF

The police force and the Anti-Corruption Agency – two crucial institutions leading the fight against malpractices and corruption. Yet they are sadly disappointing in their inability to even clean up their own backyards.

The first we all know because among the first things that this government did after the last general election was to convene a Royal Commission from February 2004 to enquire why that institution had gone so far down the road of self-destruct and to make recommendations as to how to enhance again its operations and management. That was our Polis Diraja Malaysia (PDRM).

I briefed the Royal Commission that police corruption was so extensive that a very senior ACA officer had confided in me and another top retired police officer that 40% of the senior officers could be arrested without further investigations – strictly on the basis of their lifestyles. One state police chief had a net worth of RM18mil. My friend and I had watched the force getting deeper and deeper into the morass of corruption."

Petikan tulisan bekas Ketua Polis Negara, Tun Hanif Omar dalam Sunday Star semalam, adalah satu tamparan terbuka.

Sebagai bekas Ketua Polis, bercakap mengenai polis, tentulah menjadi penumbuk yang cukup berat 'weight'nya. Ia ada authoritative appeal.

Kerajaan Abdullah mesti memberikan respon segera terhadap beberapa isu yang dibangkitkan.

a. Rasuah di kalangan anggota polis termasuk berpangkat tinggi adalah berleluasa. 40% pegawai tinggi polis boleh ditangkap tanpa penyiasatan panjang kerana kehidupan mewah melebihi pendapatan boleh dijadikan ukuran.

b. PDRM masih tidak dapat memulihkan imejnya walaupun Laporan Suruhanjaya Diraja telah dikeluarkan lebih dua tahun setengah yang lalu. Cadangan Suruhanjaya Diraja itu sia-sia.

"The Royal Commission Report was made public two-and-a quarter years ago, yet PDRM has still not burnished its image. It is still mired in controversy."

"By not letting the IPCMC see the light of day after such a long study by the AG speaks volumes of the AG’s understanding of the seriousness of the problem and its effect on the criminal justice system."

c. Pegawai atasan polis terbelah dua. Satu pihak menahan apa yang dikatakan penjenayah dan satu pihak lagi dengan kerjasama BPR menyiasat pihak yang menahan apa yang dikatakan penjenayah.

" It is so clearly divided into at least two groups at the top and, consequently, affects the officers below. That is why one group carries out arrests of alleged crime kingpins and the other group and the ACA have allegedly interrogated the arresting officers in the belief that the first group is eliminating the informants of the other group.

"Whom can we believe when one group is headed by the IGP and the other by a police director backed by the Deputy Minister of Internal Security? They are at opposite poles."

d. Sejauh mana benarnya kenyataan Peguam Negara bahawa kedua-dua Ketua Polis dan Timbalan Menteri Dalam Negeri bersih dari tuduhan rasuah terhadap mereka tidak dapat dipastikan.

"Both the IGP and the Deputy Minister of Internal Security have allegations of corruption thrown at them but both have been investigated by the ACA, the content of the reports to the AG we do not know. What we know is that the AG has absolved both of them. So, between the two, whom are we to believe?"

e. Peguam Negara hilang kredibiliti

"The AG himself has lost his credibility for this recalcitrance and for his “defeats” in recent high profile cases as well as for some high profile cases not seeing the light of day after so long in his hands: and this is disastrous because his Chambers is the second other vital institution in the criminal justice system."

f. BPR telah gagal sepenuhnya bertindak terhadap ikan jerung

"The ACA is another vital institution. It is its abject failure to act hard against the highly corrupt at the very top levels all these years that has allowed this pervasive corruption culture to thrive and grow within the public sector."

Tulisan ini memuatkan dakwaan-dakwaan yang berat. Fenomena serius yang dibangkitkan oleh Tun Hanif ini boleh meruntuhkan negara.

Dakwaan ini tentunya tidak boleh dibiarkan berlalu. Kerajaan perlu memberikan respon. Jangan sekadar secepat kilat memberikan respon tentang '40 kerusi BN hilang' tetapi membisu dalam isu kritikal seperti ini.

Laporan akhbar The New Straits Time hari ini, memperkukuhkan lagi dakwaan Tun Hanif dan buah mulut rakyat jelata yang keliru mana satu polis mana satu penjenayah. Mana satu polis yang jujur dan amanah dan mana satu penjenayah beruniform polis.

The Anti- Corruption Agency (ACA) is investigating whether the arrest of a Johor-based businessman was an "abuse of power" by the police.

The businessman was banished to Jeli, Kelantan, last Wednesday.

The suspect was earlier cleared of any involvement in illegal gambling, prostitution or drug activities by the ACA and the secret society, vice and gaming division of Bukit Aman federal police headquarters in June.

ACA sources said the allegation of abuse of power was one of the factors the ACA was looking into as it probes the circumstances of the suspect’s arrest.

Mengapa kita perlu memerangi rasuah? Adakah ianya bertujuan untuk menjaga kepentingan masyarakat atau imej Malaysia? Ini adalah kerana, usaha memerangi rasuah dilihat seolah-olah untuk menjaga imej Malaysia di mata dunia. Ini merujuk kepada sikap menjadikan standard daripada badan antarabangsa untuk menentukan tahap pencemaran amanah di dalam negeri. Bagaimana mungkin orang luar lebih mengetahuinya?

Kita mungkin boleh melihat dengan jelas pencemaran alam sekitar, tetapi pencemaran amanah sukar untuk dilihat, hanya anggapan-anggapan tanpa bukti yang dapat dilakukan.

Samada usaha (memerangi rasuah) ini adalah untuk menjaga kepentingan pihak tertentu atau sekadar menjaga imej , kedua-duanya bukanlah sebab yang sebenar usaha ini mesti dilakukan. Rasuah, samada ia untuk menjaga imej ataupun tidak, atau ia dilihat sebagai pemberian hadiah atau bukan, ia tetap haram. Meletakkan status sesuatu pemberian (hadiah/cenderahati/cenderamata/cenderabudi) itu rasuah atau tidak mestilah merujuk dalil dan nas, bukan dengan menggunakan akal dan hawa nafsu.

Rasuah bermaksud suatu pemberian kepada seseorang - samada berpangkat atau tidak - setelah menyelesaikan suatu urusan yang mana urusan itu sebenarnya wajib dikerjakan walaupun tidak mendapat pemberian.

Rasulullah SAW bersabda :

"Allah SWT melaknat penyuap dan orang yang menerima suap dalam urusan pemerintahan" [HR Abu Dawud]

"Rasulullah SAW melaknat penyuap dan orang yang menerima suap serta perantara antara keduanya" [HR Imam Ahmad]

Rasulullah SAW juga melarang seseorang pemimpin atau pegawai yang diberi kuasa untuk menerima hadiah.

Diriwayatkan oleh Imam Bukhari, dari Abi Humaid As Saidi yang mengatakan: " Nabi SAW. pernah memuji seseorang lelaki dari Bani Asad kerana kejujurannya. Tetapi, pada suatu hari, tatkala ketika dia pulang mengadap Rasulullah SAW dari suatu tugasan, ia berkata:

"Ya Rasulullah, (harta) ini kuserahkan kepada anda, sedangkan ini pula adalah hadiah mereka kepadaku"

Rasulullah SAW kemudiannya terus naik ke mimbar (Setelah memuji dan mengagungkan Allah) lalu bersabda dengan nada yang keras:

"Bagaimanakah keadaannya seorang lelaki yang telah aku hantar untuk menyelesaikan suatu urusan, kemudian datang bertemu denganku lalu berkata: 'Ini adalah ( harta) untuk anda, dan ini ( harta) yang dihadiahkan kepadaku.' Adakah dia akan mendapat hadiah itu jika ia hanya duduk di rumah bapa atau ibunya? [Imam Bukhari]

Maka dengan itu, hukumnya adalah haram bagi mereka-mereka yang meminta diberikan sesuatu hadiah kerana urusan yang sudah menjadi tanggungjawab mereka, samada kakitangan kerajaan mahupun swasta. Samada kerani, pegawai atasan sehinggalah kepada peringkat pemimpin.

Kesimpulannya, usaha memerangi rasuah bukanlah kerana kepentingan tertentu, tetapi ia dilakukan semata-mata ia dilaknat oleh Allah SWT dan RasulNya. Wallahu alam

In semi-democratic country like Malaysia, politicians (UMNO) are above the law as the check and balance mechanisms are no longer applied. Every important post in Malaysia, whether the appointment of vice-chancellor, IGP, Anti-corruption director to name but a few is becoming a political tool for UMNO leaders to maintain their establishment rather than to serve rakyat. Indeed it is very clear that the clear line between excutive power and legislative power has been significantly eroded since Mahathir vs. Salleh Abas two decades ago, making more difficult for rakyat to challenge UMNO politicians. It is likely drive a car without a brake. UMNO leaders in Malaysia is becoming more-more stubborn, untouchable and work for betterment for their cronnies, instead working for rakyat.

It is disheartening to see in Malaysia, we have anti-corruption but it is headed by those who corrupt. The same is also for our police. As proverb goes fish rot from head, it is very true indeed in our bolehland. Since both departments which are entrusted by rakyat to get rid vice activities such as corruption, organised criminals to name but two are already crumble what we rakyat should expect. Corruption, crime, rape, drug addiction are mushrooming in every nook and cranny of our cities and villages. Even Malaysia is experiencing physical development which is usually measure in terms of high rise building but it is not matched by its quality of life. Nowadays people are more afraid, they feel unsave to let their children to walk to school even not too far from their houses.

It is timely for rakyat to teach corrupt UMNO leaders who choose corrupt officers to hold high offices in our government agencies to ensure their hegemony to an end. In the coming general election every voter must use his or her right to elect a clean government. Your day is numbered UMNO corrupt leader.

Dato' Husam Musa ni pun satu hal. Pasal perlantikan Hakim Besar Malaya ditolak oleh raja-raja. Adakah patut dia minta Pak Lah berfikir dua kali. Kalau minta Nik Aziz fikir dua kali tak apa la sebab dia jenis boleh berfikir. Pak Lah ni pula bukan boleh jenis berfikir dan dia layak jadi penyambut tetamu sahaja. Zaman Mahathir dia jadi Menteri Luar itu jawatan terbaik dia dalam kabinet. Menjadi PM adalah satu beban yang tak tertanggung oleh beliau sebab itu dia bagi Khairy memerintah.

Lagi mulia kalau Pak Lah jadi Imam masjid Putrajaya, alunan suaranya cukup bagus untuk membaca khutbah (bukan berkhutbah). Dengarkan betul - betul ketika beliau memberikan ucapan yang panjang. Suaranya seperti orang berkhutbah. Makin lama makin perlahan dan perlahan dan perlahan. Kesian dia.

DAH LA HUSAM ANA NASIHAT ANTA TOKSAH DOK SUROH ORANG TUA TU BERFIKIR. KALAU DIA BERFIKIR LAMA-LAMA DIA AKAN TERTIDUR. Suroh dia berhenti lagi afdal. Bila berhenti, Jeanne boleh dodoikan kalau nak tidor. Tidor Jean dodoikan, dah lena mimpi jumpa Endon.
